Idaho Domestic Violence Firearm Purchase and Possession Prohibitions

Idaho does not prohibit persons convicted of misdemeanor crimes of domestic violence from purchasing or possessing firearms or ammunition.

Idaho does not prohibit persons subject to domestic violence protection orders from purchasing or possessing firearms or ammunition.

Domestic Violence Civil Protection Orders that Require Removal

Idaho does not require removal of firearms or ammunition from subjects of domestic violence protective orders; however, Idaho law states that, “[u]pon a showing that there is an immediate and present danger of domestic violence to the petitioner,” a court issuing a domestic violence protection order, issued after notice and hearing, may order “[o]ther relief … as the court deems necessary for the protection of a family or household member, including orders or directives to a peace officer, as allowed under this chapter.”1 Additionally, a court issuing an ex parte temporary domestic violence protection order, may order “other relief as the court deems necessary for the protection of a family or household member, including orders or directives to a peace officer, as allowed under this chapter[.]”2

Individuals Who May Petition for a Protection Order

The following persons may petition for a protection order:

  1. Spouses;
  2. Former spouses;
  3. Persons related by blood, adoption, or marriage;
  4. Persons who currently or formerly resided together;
  5. Persons who have a child in common (regardless of marital relationship or shared residency);
  6. Persons in a dating relationship.3

Penalties for Violation

Where the subject of the protection order had notice of the order, a violation of a protection order shall be a misdemeanor punishable by up to one year in jail and a fine not to exceed $5,000.4
